Terms of Service
1. Owner or Client (herein after referred to a as Shipper) is the registered legal owner of said vehicle(s) and has authority into this
Agreement with AFT Logistics, Inc (herein after referred to as AFT) or has been duly authorized by legal owner to enter into this Agreement
2. This order is subject to all terms and conditions of the transporter’s straight bill of lading, available from the carrier or incorporated herein.
3. Shipper is responsible for properly preparing the vehicle(s) for transport. All protruding or loose parts and accessories (i.e. fog lights,
antennas, low spoilers, luggage racks, bike racks, bra cover etc.) shall be removed or properly secured by shipper. Any part’s that fall off
in transit or damages done by said part(s) will become the sole responsibility of the shipper.
4. All fees due at delivery will be paid in the form of CASH or CASHIER’S CHECK ONLY (US monies). No other forms of payment will be
accepted at time of delivery.
5. Federal regulations prohibit us from knowingly transporting personal household items. If such items are shipped, unbeknown to AFT, items
become the sole responsibility of the shipper. Shipper will be subject to additional charges at the discretion of the transporter. No valuables,
electronics, live pets, alcohol, drugs or firearms will be transporter and cannot be left in vehicle(s).
6. Door to Door means the driver will get as close as legally and safely as possible to the address requested. Due to safety and road
restrictions for the transporter and vehicles, the driver has sole discretion as to the pick up and delivery locations. The shipper agrees to meet
the driver at the location deemed by the driver to be more accessible within 25 miles of the requested address. The Shipper is hereby notified that
the vehicle will be driven on and off the transporter, or possibly to and from the transporter at origin or destination, should transport be unable to
access either site. This does not relieve shipper from making an effort to meet transporter at location.
7. AFT will not be responsible for demurrage or storage fees acquired at Port of Call in entering or exiting the United States.
8. All quoted prices are for operable vehicle’s (rolls, steers, brakes and drives property) unless noted otherwise. If vehicle(s) is inoperable or
over sized (longer than 16 feet, overweight etc...) and AFT was not advised when order was placed, a charge of $200.00 for inoperable
and/or $300.00 for over sized will be assessed. If vehicle becomes inoperable during transit a minimum fee of $100.00 will be assessed.
All assessed fees are due COD at delivery.
9. AFT agrees to transport your vehicle as promptly as possible, in accordance with your order, but we cannot guarantee transport
by a specificdriver/transporter nor can we guarantee a specific date for pickup or delivery although we do guarantee a window of pickup
AFT is licensed as a broker and does not transport vehicles.
10. If Transporter is unable to contact shipper via telephone (by phone numbers provided by shipper (3-24 hours prior to delivery) or shipper
cannot take delivery of vehicle or shipper does not have proper funds, vehicle(s) will be taken the nearest terminal, at discretion of driver.
Shipper can retrieve vehicle from terminal upon full payment (certified funds) of all owed delivery, redelivery and terminal fees.
11. Department of Transportation Regulations requires that all tariffs (monies) must be paid in full to initiate a claim and all claims be submitted in
writing, should damage occur. Shipper agrees to pay all tariffs due at time of delivery and will not seek to charge back a credit card or stop
payment on any funds to offset any dispute for damage claims. Shipper agrees to hereby release and holds AFT harmless from any claims
or damages and agrees to file all claims directly with the Transporter as noted below. AFT agrees to help with claims, to the best of their
knowledge.
12. It is strongly recommended that shipper inspect the vehicle prior to pick up and delivery. All damage must be noted on the Bill of Lading prior
accepting vehicle(s), as to protect shipper should claim arise. Signing of the Bill of Lading without damage noted will be proof of satisfactory
delivery. Insurance for your vehicle(s) is only provided by the actual truck carrying your vehicle. Brokers are restricted by law from
providing your vehicle with insurance. The Tranporter's Insurance is Primary
13. If damage does occur, arising from or related to the transporting of said vehicle(s), shipper agrees to notate the Bill of Lading at delivery and
to file any and all claims within 15 days. Shipper agrees to mail a copy of the following directly to the Transporter: Bill of Lading receipts,
three estimates from three different certified auto repair shops and two pictures per damaged area. Bill of Lading must be signed by shipper
and transporter regardless of time of day, whether conditions or other circumstances that may arise.
14. Shipper has the option to cancel this agreement any time prior to the assignment of transporter.
15. AFT shall use its best efforts to schedule a transporter to pick up your vehicle in timely manner. If transporter fails to deliver your vehicle
within 23 days from the date it was loaded for transport. AFT will reimburse shipper’s rental car charges up to $20/00 per day until vehicle
is received for a maximum of seven (7) calendar days. Rental reimbursement excludes Alaska, Hawaii, Overseas moves, terminal time and
special pick ups. Rental reimbursement covers one primary vehicle. The original rental receipt must be provided by legitimate, licensed rental
company.
16. By submitting your order over the phone, via email, fax or online, AFT understands and assumes you are placing your order and accept the
terms and conditions(in lieu of your signature) found here and on AFT website.
17. Performance shall be excused for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its
control including, but not limited to Acts of God, Government Wars, Insurrections, Labor Disputes, Natural Disasters and/or any other cause
beyond the reasonable control of AFT or Transporter.
18. The provisions of this Agreement supersede all written or oral agreements between AFT Logistics, Inc and Shipper and may not be changed
except in writing by an officer of AFT Logistics, Inc. If any provision of this Agreement is held to be invalid, all other parts of this Agreement
remain in effect.
19. This agreement shall be governed by and construed in accordance with the laws of the State of Georgia. The parties further agree that any
legal action arising out of this Agreement shall be filed in District or Circuit Court of Henry County, Georgia. Customer hereby submits to
jurisdiction of such courts and waives any and all defenses based on lack of personal jurisdiction.
